Today I was downtown at Frank Murphy Hall of Justice and my client was facing a third drunk driving charge originating from Romulus. My client was faced with 5 years prison, but because of a prior felony was charged as an habitual offender and faced seven years in prison. The prosecutor's best offer was 1-5 years prison.
This offer was unacceptable and not in-line with how hard my client has been working leading up to court today. My client has been following my proactive plan, including daily AA meetings, treatment, and has been wearing an alcohol tether during this case.
After speaking to the judge and prosecutor prior to the case, we were able to all come to an agreement where my client will avoid prison time altogether, will instead do probation, alcohol treatment and be granted the opportunity for work-release instead of any jail time. This will hopefully allow my client to keep his job, support his family and remain free.
Ultimately clients need to decide between two options - going to trial and the best possible deal the prosecutor and judge will agree to. It was looking like my client's only option was going to trial to avoid seven years in prison, but fortunately my client's efforts on my proactive plan paid off, and I was able to convince the judge to agree to a very favorable sentence, and my client now will get the treatment and support he needs.
