If the client is a first offender and the arresting police agency is Pittsfield Township, we will be working with the Pittsfield Township Prosecutor who is a private law firm, which is hired by the Township to prosecute cases. This means that the attorneys who handle the prosecution are also private attorneys with their own clients. In my experience, this is quite favorable for my clients who follow my proactive program (more on this later). When a prosecutor can reflect on their own clients when considering my client’s circumstance, we’re usually able to have more success in obtaining a desired result. For this particular case, I would discuss the process from A to Z with the client, and tell them more about my proactive program. If my client agrees to follow my program, I would file my attorney paperwork with the Pittsfield Township Police Department, the Pittsfield Prosecutor and with Judge Conlin’s staff at the courthouse. This process would allow us access to the police reports, video and other evidence, and allow my to begin discussions with the prosecutor. It will also allow us to control scheduling matters when it comes to the arraignment process and setting future court dates. | For a retail fraud case in Pittsfield Township, we want a pretrial where the prosecuting attorney is present, so we can work toward a possible dismissal of charges. Judge Conlin is very accommodating, and will usually do same-day sentencing, which saves my client additional trips to the courthouse, and lets the client get probation over with sooner than if they had to wait an additional 4-6 weeks for sentencing. When a client contacts me about this sort of case, I ask which police department arrested them or issued a ticket, what store they were in, and if they have any prior record. Based on those answers, we can learn a lot about the case, and begin the process of setting goals, and reaching those goals by being proactive from day one. |
