Novi Michigan DUI Traffic Stops - Judge Bondy, Mackenzie & Powers
In Novi, many police stops are based upon things like defective equipment or "minor" traffic violations like not using a turn signal or going a few miles over the speed limit. Common sense says that none of those reasons are really any indication that the person is drunk. Unfortunately the law doesn't require you to be swerving around the road in an "erratic" manner - as long as you violate the Michigan Traffic Code, the stop will probably be legal.
From there, this doesn't mean that the police can make you get out of the vehicle or start a DUI investigation, but if the officer say smells the strong odor of intoxicants on a driver’s breath, by itself, would probably provide the officer with a reasonable, articulable, particularized suspicion that the driver was driving under the influence of liquor and provided a basis for the officer to request the driver to perform roadside sobriety tests.
