In Michigan DUI cases, the courts require that a presentence investigation (PSI) be undertaken before sentencing. The investigation looks into the facts of the case from the perspective of both the police and the defendant. Usually the investigator will use the police report to ascertain the facts of the case and prepare a sentence recommendation. The judge doesn't have the time to meet everyone and learn about their backgrounds, so probation does this via a meeting with my client then a report is produced for the judge.
The client is given an opportunity to tell his or her side of the story. Among other things, the investigation will include (1) a search for possible prior alcohol convictions, (2) a check on any prior criminal history, and (3) a specific “needs evaluation” to determine the propriety of specific rehabilitation programs.
