Drunk Driving in Pittsfield Township - Client Charged with Operating With Presence Controlled Substance - Client Keeps Driver's License

7/11/2014

Recently represented a client at the 14A-1 District Court with Judge Conlin.  Client had no criminal record, and was working on his degree while working full-time.  Client had everything to look forward to in his life, but then had a bad night and was charged with Operating With Presence Controlled Substance, which is a drunk driving-like offense in Michigan.  He faced extensive jail time and loss of driver's license, which would have crippled his future with the inability to drive.

I immediately put my client on my proactive DUI defense in Washtenaw County, which allowed him the opportunity to show the judge, and prosecutor that he deserved an exceptional result, and to keep his license and stay out of jail.  My client wasn't satisfied with the average result, so I handed him the tools to strive for something worthy of his character and stage in life.

After exploring all of our options, and gathering all the information on the case, my client decided to put my proactive plan into high gear, and asked me to try to negotiate the best deal on his behalf.  My client gave me the ability to show action rather than just words.

Instead of telling the prosecutor and judge that my client is NOT drinking or doing drugs, I was able to show them PBT results and drug screens.  Instead of saying he's not going to do this again, I showed them proof of attendance of multiple AA meetings.  Instead of saying my client is a positive influence in the community, I was able to show them sign-in sheets for 40 plus hours of community service done during the pendency of the case.

My plan and my client's hard work earned him a dismissal of his original charge, which would have taken away his driver's license, and my client was given the lowest drunk driving charge and allowed to keep his license and avoid jail.  My client was given non-reporting probation, which allowed him to remain living and going to school 3 hours away from the courthouse.
