In Washtenaw County, a client with a BAC level over 0.17 will find themselves in a difficult position. Unlike some other counties, the Washtenaw County Prosecuting Attorney will not make any plea offer on this elevated charge. That is their policy, and they have their reasons, which they are entitled to having.
In some other counties, a client will be able to weigh the pros and cons on going to trial or accepting a favorable plea deal. In courts like the 14A-3 District Court with Judge Conlin, my clients don't have this decision to make. When there is no offer, I tell my clients that they should go to trial, because to plead straight up vs taking a shot at trial, they have nothing to lose.
So tomorrow a client of mine will go to trial on his Super Drunk charge.
