- The defendant relocated the merchandise (Any degree of movement suffices. It is irrelevant whether the defendant managed to get the merchandise past the cashier or out of the store)
- The defendant had a motive to steal the merchandise, which means the defendant intended to permanently deprive the store of the merchandise without the store's approval.
- The incident occurred inside the store or in its immediate vicinity, during business hours.
- The monetary value of the merchandise.

If the merchandise is valued under $200, it qualifies as Michigan Retail Fraud in the Third Degree, punishable as a 93-day misdemeanor. If the merchandise value ranges from $200 to $1,000, it is categorized as Michigan Retail Fraud in the Second Degree, a one-year misdemeanor. If the merchandise is worth more than $1,000, it escalates to Michigan Retail Fraud in the First Degree, a felony.

Additional variations of this offense apply when a defendant tries to execute a fraudulent return exchange or switches price tags to a lower amount. These crimes have marginally different elements but carry the same penalties.
