When I speak to prospective DUI clients, it's always important to establish how well they remember the incident. When alcohol and nerves are involved, the client's memory may not be as clear as they think. We will have to compare the client's memory to what's listed in the police and and contained in any audio or video. Here are some questions that a DUI lawyer in Michigan may ask of a client.
- How good is your memory of the incident?
- How good is your passenger’s memory?
- What was the exact location and time of the traffic stop?
- What city or jurisdiction were you in when you were stopped by the police?
- What police department stopped you? Had you driven through that jurisdiction? See MCL 764.2a.
- Were you cooperative with the police?
- Was the arresting officer polite toward you? Businesslike? Abusive?
- Did you produce your license and registration without fumbling?
- Did the officer explain why he or she stopped you? Did he or she mention any specific type of erratic driving?
- Did the officer mention that he or she had received a 911 call regarding your erratic driving?
- Did the officer ask you if you had anything to drink or how much? What did you say?
