Here are some sample questions that might be asked of a jury in a Troy DUI case. Many people believe that if your number is 0.08 or greater you're screwed. This is not the case in a Michigan DUI case. Here are some questions that I would use during the voir dire process to inform the jury of what they actually need to consider, and how a client's case must be correctly evaluated.
Does everyone understand that my client is charged with two theories of drunk driving
Do you understand that operating while intoxicated (OWI) is concerned with the effect of the alcohol on the defendant’s ability to drive?
Do you understand that no matter what the defendant’s blood alcohol level was at the time of the test, you must find the defendant not guilty if their ability to drive was not substantially affected by the consumption of alcohol?
