My client and I had a successful day in the Saline 14-A4 district court today where we received a not guilty verdict on the elevated charge of Operating with a High BAC or Super Drunk offense. Our defense was based on upon the passage of time between driving the car and the blood test sample being taken from my client.
If my client was convicted of the Super Drunk offense, he would have been required to have an ignition interlock in his car with no driving for 45 days and restricted driving for 320 days with mandatory one year alcohol treatment.
