Michigan DUI Attorney - 52-3 District Court - Judge Nancy Carniak, Lisa L. Asadoorian and Julie A. Nicholson
Before administering the DataMaster, the operator must observe the subject for 15 minutes. The observation time is to ensure that “the person shall not have smoked, regurgitated, or placed anything in his or her mouth.”
After the observation period, the operator selects “run.” The machine is always left on except during electrical storms. The display function should show the date, time, “ready,” and a flashing “run.”
Once “run” is selected, the machine instructs the operator to “insert ticket.” See exhibit 6.2 for sample evidence tickets for both the BAC DataMaster and DataMaster DMT. The operator must type into the machine information concerning the subject. This information includes the subject’s name, address, birth date, and license number. This information is then transferred to the ticket. The operator is asked to review the information and “PRESS (Y/N)”. If there are no changes, the operator types “N”. The machine is then ready to start its analysis of the breath samples.
