I get a lot of calls from potential clients who sometimes tell me a totally unrealistic story about their case. I of course listen to them and get all of the important information, but then play devils advocate for a bit with their story; nine times out of ten they are leaving out a number of parts about their case that totally change the circumstances of their defense. If it's actually what's going on and they continue to be adamant about it then we explore that option.
It's my job to advocate for my client, but not to enable unproductive denial or to allow unrealistic expectations to be set for their case. If a client wishes to go forward with unrealistic expectations, I will simply wish them the best of luck and advise that they speak to another attorney. I DO NOT sell my clients on helping them reach unrealistic expectations; it's a waste of everyone's time, and it is not in the best interest of my client.
My client and I work on realistic expectations with a clear strategy in mind. As a former prosecutor, I have some insight into the other side of the case, and what's going on over there. Our plan is developed with the prosecutor and judge in mind; we create various options, and weigh the pros and cons of each option. A client has the option to have a trial by judge or jury at all times; if a trial is in a client's best interest, I will advise to do so. Ultimately the client makes the final decision, but with my counsel and advice.
If you wish to discuss your case, and your options, I'd be happy to help you.
