Just left court with a client who was charged with a Michigan DUI offense along with another alcohol related misdemeanor. My client faced an uphill battle of going to jail and having two convictions on his record, one being a drunk driving record. My client did not simply plead guilty or roll over and accept his fate. He realized that he might have some defenses and came to my law firm for assistance.
Today my client left court without a criminal record! I was able to get the prosecutor to dismiss the drunk driving charge and allow my client to have a deferred sentence on his other misdemeanor, which means that after 90 days of non-reporting probation, the misdemeanor will be dismissed. This means my client walks away with no criminal convictions, and no drunk driving charges on his record.
This is an extraordinary result and I caution future clients to not expect the same outcome. What it does show is that SOME cases do have issues, and those issues open the door for aggressive negotiations and extraordinary results. As a former prosecutor, I know how the system works , and I was not afraid to demand the very best outcome for my client; I had to fight hard to get it, and really work with the prosecutor to get this deal, but it was well worth it.
My client left court stunned at this result, and I am very happy to achieve this result for my client and his family.
