Depending on your charge, your case may be handled by the Washtenaw County Prosecutor’s Office or a local city or township prosecutor. This is one of the most important distinctions to identify at the beginning of your case. The Washtenaw County Prosecutor’s Office handles cases County wide, including all felonies, second and third offense drunk driving cases, the majority of domestic violence cases, and some other repeat offender cases. Most first offense crimes, including drunk driving, retail fraud, possession of marijuana, minor in possession, and other similar offenses are handled by the city or township prosecutor.
These distinctions do not apply if the arresting police agency is Michigan State Police, Washtenaw County Sheriff’s Office, University of Michigan Police Department or some other agencies, because these are state agencies, and the case must go to the Washtenaw County Prosecutor’s Office, and not the localized prosecutor. More on which prosecutor is better for your case later in this book.
In general, the Washtenaw County Prosecutor’s Office will take more time to review and prosecute a case, whereas the local prosecutor such as the Ann Arbor City Prosecutor may prosecute the Monday after your weekend run-in with the law.
