If charged with a misdemeanor DUI in Royal Oak or Berkeley, the case will be heard by Judge Derek Meinecke or Judge Wittenberg who handle the drunk driving cases at the 44th District Court. The prosecutor will either be the City of Royal Oak or Berkley or an assistant prosecutor from Oakland County Prosecutor's Office, which is lead by Jessica Cooper.
The most common police departments making OWI arrests are the Oakland County Sheriff, Royal PD, Berkley PD and the Michigan State Police.
The 44th District Court does have a sobriety court, which is a useful consideration if a client is charged with a second offense. If you have an old DUI case on your record, you are eligible for a DUI Pardon, but not expungement.
