If a client is arrested for a DUI in the Pittsfield Township area, they will automatically have the Washtenaw County Prosecutor’s Office on their case if it’s a second offense. If it’s a first offense, but the police agency is the Sheriff’s Department, Michigan State Police or occasionally the University of Michigan Police Department, the prosecutor will also be the County. When charged with a DUI offense at the 14A-1 Court, my client and I will discuss my proactive program in order to best position our case with the prosecutor and Judge Conlin. My attorney appearance will combine the arraignment and the pretrial, allowing us to combine two court dates into one, and give us time to obtain the evidence in the case. | In my experience, cases handled by Judge Conlin are typically probation cases, meaning jail is a rare outcome unless there are some unusual circumstances. In my experience, the County prosecutor is less likely to dismiss or reduce charges compared to a case handled by Pittsfield Township, but even the Township can be quite strict with certain cases. My client and I are usually able to create the option of a reduction in charges if they follow my proactive program, but if the facts lend themselves to defenses at trial, my client may elect to test the evidence with a bench or jury trial. |
